1. Acceptance of Terms
Welcome to ShiftCare by AlphaCare. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all users, including employers, employees, and any other individuals who access or use ShiftCare services.
2. Description of Services
ShiftCare provides urgent care membership services that allow enrolled members to access healthcare at participating partner clinics. Our services include:
- Membership enrollment and management
- Digital membership card issuance via SMS
- Access to partner urgent care clinic network
- Employer dashboard and reporting tools
ShiftCare is not an insurance product. We facilitate access to healthcare services through our partner network under a membership model.
3. Eligibility
To use ShiftCare services, you must:
- Be at least 18 years of age
- Be enrolled through a participating employer or as an individual member
- Provide accurate and complete registration information
- Maintain the confidentiality of your account credentials
4. Membership and Fees
Pricing
Membership fees are charged on a per-employee, per-month basis as agreed upon with your employer. The current standard rate is $50 per member per month. Fees may be subject to change with advance notice.
Payment
Employers are responsible for payment of membership fees for enrolled employees. Payment terms are established in the employer agreement.
No Refunds
Membership fees are non-refundable except as required by law or as otherwise specified in your employer agreement.
5. Using ShiftCare Services
Digital Membership Card
Upon enrollment, you will receive a digital membership card via SMS. This card is for your personal use only and must be presented at partner clinics to receive services.
Partner Clinics
ShiftCare membership provides access to services at participating partner clinics only. Services received at non-partner facilities are not covered under your membership.
Covered Services
Membership covers urgent care services as defined in your plan. Certain services, including but not limited to emergency room visits, specialist referrals, prescription medications, and procedures outside the scope of urgent care, may not be covered.
6. User Responsibilities
You agree to:
- Provide accurate, current, and complete information
- Use your membership only for yourself (memberships are non-transferable)
- Not share, sell, or misuse your membership credentials
- Comply with all applicable laws and regulations
- Treat clinic staff and other users with respect
- Report any unauthorized use of your account immediately
7. Healthcare Disclaimer
ShiftCare is not a healthcare provider. We facilitate access to healthcare services through our partner clinic network. All medical care is provided by independent healthcare professionals at partner clinics.
We do not provide medical advice, diagnosis, or treatment. Any health-related decisions should be made in consultation with qualified healthcare professionals.
In case of a medical emergency, call 911 or go to the nearest emergency room. ShiftCare membership is not a substitute for emergency care.
8. Intellectual Property
All content, trademarks, logos, and intellectual property associated with ShiftCare are owned by AlphaCare or its licensors. You may not use, reproduce, or distribute any ShiftCare materials without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, ShiftCare and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid for services in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless ShiftCare, AlphaCare, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
11. Termination
Your membership may be terminated:
- By your employer discontinuing the ShiftCare plan
- By you upon separation from your employer
- By ShiftCare for violation of these Terms
- By ShiftCare for non-payment of membership fees
Upon termination, your access to ShiftCare services will cease, and your digital membership card will be deactivated.
12. Dispute Resolution
Any disputes arising from these Terms or your use of ShiftCare services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in class action lawsuits against ShiftCare.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of ShiftCare services after any changes constitutes acceptance of the new Terms.
